1. Agreement to these terms

By accessing akilbaev.com, submitting an inquiry, or placing an order, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the site or place an order.

We may update these terms from time to time. The “Last updated” date at the top of this page shows when changes take effect. Continued use of the site after changes means you accept the revised terms.

2. Seller and website

This website is operated by or on behalf of Amon Akilbaev (“we,” “us,” or “the Studio”), an artist offering original artwork and made-to-order metal prints through this online store.

3. Products and orders

• Listings describe metal fine art prints produced from the artist’s works. Unless clearly labeled otherwise, items offered for online checkout are prints, not original paintings.
• Each order is custom-produced after checkout according to the artwork, size, and finishing options you select (surface, corners, presentation, hardware, and similar options shown at checkout).
• We reserve the right to refuse or cancel an order before production begins, including for suspected fraud, pricing errors, or restrictions on shipping to your address.
• Product images are representative. Minor variation in color, finish, or materials may occur because prints are produced by third-party print partners and displays differ from physical products.

4. Pricing, taxes, and payment

• Prices are shown in United States dollars (USD) unless stated otherwise and include the pricing shown at checkout for the selected print size.
• Where applicable, sales tax or import duties may be calculated or collected by the payment provider or carrier according to your location.
• Payment is processed securely by Stripe. We do not store full payment card numbers on our servers.
• Your order is confirmed when payment is successfully completed and you receive an order confirmation by email.

5. Production and fulfillment

Metal prints are made to order. Production and fulfillment times vary by size, finishing options, print partner workload, and destination. Estimated timelines are not guaranteed unless we expressly agree otherwise in writing.

If we cannot fulfill your order, we will contact you and offer a refund of the amount paid for that order.

6. Shipping and delivery

• Shipping options and costs, if any, are shown or described at checkout. Promotional free shipping within the United States applies only where stated for the selected product.
• Risk of loss passes to you upon delivery to the address you provide. You are responsible for providing an accurate shipping address and for receiving the shipment.
• International orders may be subject to customs clearance, import fees, or delivery delays outside our control. Those charges are your responsibility unless required otherwise by law.

7. Intellectual property

All artwork, images, text, logos, and site content are owned by Amon Akilbaev or used with permission and are protected by copyright and other intellectual property laws.

You may not copy, reproduce, distribute, publicly display, create derivative works from, or commercially exploit site content or artwork except as expressly allowed in these terms or with prior written permission from the Studio.

8. License for purchased prints

• When you purchase a print, you receive a physical product for personal display and non-commercial use only.
• Your purchase does not transfer copyright or any right to reproduce, resell, license, or upload the image for commercial use, stock licensing, AI training, or similar purposes.
• Any commercial license, exhibition, or reproduction rights must be negotiated separately in writing with the Studio.

9. Prohibited conduct

• Using the site unlawfully or in a way that could harm the Studio, other users, or third parties.
• Attempting to interfere with site security, payment systems, or order processing.
• Misrepresenting your identity, payment authorization, or shipping information.

10. Disclaimers

The site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are not allowed.

We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, the Studio and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or purchase of products.

Our total liability for any claim relating to an order or the site will not exceed the amount you paid for the order giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

12. Disputes, governing law, and contact

• Please contact us first at the emails above so we can try to resolve concerns informally.
• These terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise.
• If a dispute cannot be resolved informally, it may be brought in the courts or forums competent at our principal place of business, unless applicable law gives you the right to bring claims in your home jurisdiction.
